Overview

Each year, 10,000 investor visas, known as EB-5 visas, are available to qualified individuals who are looking for permanent resident status in the United States and who are engaging in a new commercial enterprise.

Half of those visas are put aside for those individuals who apply under a pilot program involving a “Regional Center” that is designated by the citizenship and immigration services.

A Regional Center focuses on a specific location within the country and its purpose is to promote growth of the economy through the creation of new employment opportunities, increased sales of export, improved regional productivity, and increased domestic capital investment.

According to eligibility requirements, the investor must demonstrate that it is a “qualified investment” that is being made in the new commercial enterprise located within an approved Regional Center. In addition, the investor must show that at least 10 jobs are created directly or indirectly from the enterprise.

Eligibility

EB-5 visas are available to investors, either alone or coming with their spouse and children who are unmarried. Eligible aliens are individuals who have invested, or are actively in the process of investing, the required amount of capital into a new commercial enterprise that they have established. The investment has to be demonstrated on how it will benefit the economy within the United States and create the 10 or more full-time jobs for qualified individuals within the United States.

E2

Overview

An E2 visa is a non-immigrant visa reserved for investors from a country with which the United States maintains a treaty of commerce. These individuals wish to come to the United States to develop and direct business operations of the enterprise that they have invested in; or, they are in the process of investing a substantial amount of capital.

Eligibility

The applicant is required to come to the United States to develop and manage the operations of an enterprise in which the applicant has invested or is actively in the process of investing a substantial amount of capital. The applicant must have more than fifty (50%) percent ownership of the investment, unless the applicant is coming as an employee of the enterprise.
